Waiver & Code of Conduct

Release of Liability, Assumption of Risk, and Indemnity Agreement — please read carefully before participating.

In consideration of being allowed to participate in any way in the activities, programs, events, leagues, tournaments, or open play hosted or organized by St Pete Ballers Club LLC (together with its owners, officers, members, organizers, employees, volunteers, officials, sponsors, affiliates, and agents, collectively "the Club"), I, the undersigned, acknowledge and agree to the following:

1. Assumption of Risk

I understand that participation in volleyball and related activities involves inherent risks including, but not limited to: falls; collisions; physical contact with other participants; muscle, joint, and other bodily injury; environmental exposure such as sun, heat, sand, water, wind, and weather; uneven or hazardous playing surfaces; equipment failure; and the actions or omissions of other participants and third parties — any of which may result in injury, illness, permanent disability, or death. I voluntarily choose to participate and fully accept all such risks, both known and unknown.

2. Release and Waiver of Liability, Including Negligence

I hereby release, waive, discharge, and hold harmless the Club, and the owners, operators, and managers of any venue or property at which Club activities take place, from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or relating to any loss, damage, injury (including death), or other harm I may sustain while participating, including any such loss, damage, injury, or harm caused in whole or in part by the ordinary negligence of the Club or other released parties, to the fullest extent permitted by Florida law.

3. Medical Treatment

I authorize the Club to secure emergency medical care on my behalf if deemed necessary during participation. I accept full financial responsibility for any such care and represent that I either carry adequate health insurance or accept personal responsibility for all medical costs arising from my participation.

4. Personal Responsibility

• I affirm that I am physically fit to participate and have no medical condition that would make participation unsafe.
• I will follow all posted rules, verbal instructions, and safety guidelines.
• I am solely responsible for my personal belongings.

5. Photo & Video Release

I consent to the Club's use of photographs, videos, or recordings taken during Club activities, which may include my image or likeness, for promotional and marketing purposes, without compensation.

6. Indemnification

I agree to indemnify and hold harmless the Club against any claims, damages, or expenses (including reasonable attorneys' fees) arising out of my participation or my breach of this agreement.

7. Participants Under 18

If the participant is under 18 years of age, the undersigned parent or legal guardian, on behalf of themselves and the minor participant, agrees to all terms of this agreement, consents to the minor's participation, and acknowledges that they are releasing claims and assuming risks on the minor's behalf to the fullest extent permitted by Florida law.

8. Scope, Governing Law & Severability

This agreement applies to all activities organized by the Club — including pickup games, leagues, tournaments, practices, and events — on an ongoing basis unless revoked by me in writing. It is governed by the laws of the State of Florida. If any portion of this agreement is held invalid, the remainder shall continue in full force and effect. I acknowledge that I have had sufficient opportunity to read this entire agreement, have read and understood it, and agree to be bound by its terms voluntarily.
